Pentest Disclaimer & Liability Waiver

By using IntrudR, you acknowledge and accept full legal responsibility for all scanning activities performed through your account. Unauthorized scanning of systems you do not own or have explicit permission to test is illegal and may result in criminal prosecution.
1. Authorization Requirement
You MUST have explicit, written authorization from the owner of any system, network, or application before initiating a scan through IntrudR. This authorization must be documented and verifiable. We strongly recommend that you have a signed penetration testing agreement with the target owner that clearly defines the scope, timeframe, and boundaries of testing.
2. User Responsibility
IntrudR is a tool. The user bears full and sole legal responsibility for how the platform is used. You are responsible for ensuring that your use of IntrudR complies with all applicable local, national, and international laws and regulations. IntrudR does not verify whether you have authorization to scan a given target.
3. No Liability for Damages
IntrudR is not responsible for any damage, disruption, or loss caused by scans initiated through our platform, including but not limited to:
- Service downtime or degradation of target systems
- Data loss or corruption on target systems
- Network disruptions or bandwidth consumption
- Any consequential damages arising from vulnerability exploitation
- Legal consequences resulting from unauthorized scanning
4. Legal Framework
Unauthorized access to computer systems is a criminal offense under multiple jurisdictions, including but not limited to:
- United States: Computer Fraud and Abuse Act (CFAA), 18 U.S.C. § 1030
- European Union: Directive 2013/40/EU on attacks against information systems
- France: Articles 323-1 to 323-8 of the French Penal Code
- United Kingdom: Computer Misuse Act 1990
Violations can result in significant fines and imprisonment. Ignorance of the law is not a defense.
5. Indemnification
You agree to indemnify, defend, and hold harmless IntrudR, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to your use of the platform, your violation of these terms, or your violation of any applicable law.
6. Logging & Law Enforcement Cooperation
For legal compliance and security purposes, we log all scan targets, timestamps, and associated account information. We may cooperate with law enforcement agencies and respond to valid legal requests, subpoenas, and court orders. In cases of suspected illegal activity, we may proactively report information to relevant authorities.
7. Recommended Best Practices
- Always obtain a signed penetration testing agreement before scanning
- Clearly define the scope and boundaries of testing in writing
- Maintain records of all authorizations and communications
- Notify the target owner of testing schedules in advance
- Have legal counsel review your authorization documents
- Start with non-intrusive scans and escalate only with explicit permission
